1. Essential Contractual Safeguards

The Mechanic's Lien Trap

Even if you pay your General Contractor in full, unpaid subcontractors or lumber suppliers can place a mechanic's lien against your home. Always require signed Conditional Lien Waivers with each draw and Unconditional Lien Waivers upon payment clearing.

  • Milestone Payment Draw Schedules: Never pay more than 10% down (or state legal limits). Tie disbursements to passing municipal building inspection milestones (e.g. rough framing, rough electrical/plumbing, drywall completion).
  • Mandatory Written Change Orders: Any deviation in scope, material selection, or structural modification must be documented in a written Change Order specifying exact cost and schedule impacts prior to work execution.
